The legal aspects of buying a new build property can be more complicated than for other types of residential transaction. We do not believe in a one size fits all approach, and so we assign every new build purchase to a specialist team that is overseen by experienced, qualified lawyers who understand both the legal detail and the commercial reality of buying from a developer.
Property lawyers working on new build purchases need to work quickly because of the tight exchange deadlines imposed by developers, which can often be as short as twenty-eight days from reservation. Equally, however, it is essential to have an experienced lawyer capable of navigating the various issues that arise on a new build property, ranging from planning permission and building regulations approvals to the status of the estate roads and sewers.
You will need a lawyer who can review and advise you on vast amounts of paperwork in a clear, succinct and accessible manner. As part of our service, you will receive advice on the new build warranty on offer, any restrictions on the use of the property imposed by the developer in the form of covenants, and warnings about any risks associated with the development you are purchasing on.
Every new build matter we handle includes the following as standard:
A detailed review of the contract pack supplied by the developer, including the transfer or lease, the title plan and all supporting paperwork.
Advice on the new build warranty (NHBC, LABC, Premier Guarantee or similar) and the protection it provides.
A review of all planning permissions, building regulations approvals and any conditions attached to them.
An explanation of the covenants and restrictions that will bind you and any future owners of the property.
A review of the position on estate roads, sewers and any management company arrangements, including ongoing estate rent charges where they apply.
Coordination with your mortgage lender to ensure that the property meets their new build requirements.
Management of the developer’s exchange deadline so that you do not lose your reservation fee.
While we will of course give you the general information that is applicable to all new build purchases, you will also receive bespoke advice that is specific to your individual transaction. We do not simply repeat generic advice, as is the case with many other property lawyers who handle new build work in volume.
Some new build conveyancers have commercial relationships with the developer who is selling the property. In return for acting on many plot purchases, they may pay the developer a form of commission or sit on a developer panel. MJP values its independence above all else.
